Terms and Conditions

Welcome to Malike Digital. These Terms and Conditions outline the rules and regulations for the use of our website and the purchase of our products. By accessing this website or purchasing from our store at Bihi Towers, you accept these terms in full.

1. General Conditions

  • Agreement: By using our services, you represent that you are at least the age of majority in your county or residence.

  • Service Refusal: We reserve the right to refuse service to anyone for any reason at any time.

  • Accuracy: While we strive for perfection, we do not warrant that product descriptions or other content on this site are 100% accurate, complete, or error-free.

2. Products and Pricing

  • Authenticity: Malike Digital guarantees that all Apple products sold are 100% authentic and original.

  • Price Changes: Prices for our products are subject to change without notice due to currency fluctuations (KES/USD) and market demand.

  • Availability: We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction.

3. Payment Terms

  • Accepted Methods: We accept M-Pesa (Till Number), Bank Transfers, and Credit/Debit Cards.

  • Verification: Orders are only processed once payment is fully verified. For high-value transactions, we may request additional identification to prevent fraud.

  • Ownership: Ownership of the goods passes to the customer only upon full payment of the purchase price.

4. Shipping and Delivery

  • Nairobi Delivery: Same-day delivery is available for orders placed before 3:00 PM within Nairobi.

  • Countrywide Shipping: We ship across Kenya via trusted couriers (G4S, Wells Fargo, etc.). While we ensure secure packaging, Malike Digital is not liable for delays caused by third-party courier services.

  • Risk of Loss: The risk of loss and title for such items pass to you upon our delivery to the carrier.

5. Warranty and Liability

  • Apple International Warranty: Most new devices come with a 1-Year Apple Limited Warranty. Technical support and hardware repairs are handled by Apple Authorized Service Providers.

  • Limitation of Liability: Malike Digital shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products.

  • User Responsibility: It is the customer’s responsibility to inspect the device upon delivery or pickup.

6. Trade-In Program

  • Valuation: All trade-in valuations provided via WhatsApp or in-person are estimates. A final value is only confirmed after a physical technical inspection at our Bihi Towers shop.

  • Data Privacy: Customers are responsible for backing up and erasing all personal data from trade-in devices before handing them over. Malike Digital is not responsible for lost data.

7. Returns and Refunds

  • Valuation: All trade-in valuations provided via WhatsApp or in-person are estimates. A final value is only confirmed after a physical technical inspection at our Bihi Towers shop.

8. Privacy Policy

  • Your submission of personal information through the store is governed by our Privacy Policy. We do not sell or share your data with third parties except as necessary to complete your transaction (e.g., sharing your address with a courier).

 

9. Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the Laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nairobi.
